I. General provisions

 

 

This Privacy and Personal Data Protection Policy provides information on:

- the way in which STOKODA ACADEMY (referred to as SA for short) processes personal data of natural persons, including: applicants/recipients of services, employees, contractors of SA;

- the technical and organizational measures taken to protect the collected or received personal data of natural persons;

- the rights of individuals whose personal data is processed by SA.

 

 

II. Information about the controller of personal data

 

 

STOKODA ACADEMY acts as a personal data controller, within the meaning of Art. 4, § 7 of the General Data Protection Regulation (Regulation (EU) 2016/679), in cases where it processes personal data on its own behalf and in connection with its activity, determining the purposes and means of their processing.

III. Principles

 

 

As an administrator and as a processor of personal data, STOKODA ACADEMY complies with the principles of personal data protection provided in Regulation (EU) 2016/679  and the legislation of the European Union and the Republic of Bulgaria.

 

 

IV. Grounds for processing

 

 

1. For the performance of its activity and mental training of athletes, coaches and other individuals, STOKODA ACADEMY acts by collecting voluntarily provided personal data, with the purpose of processing them for the needs of the goals that have been set.

2. To comply with legal obligations that apply to SA.

3. To implement activities in the public interest.

4. For the performance of contracts to which data subjects are a party, or to take steps at the request of the data subject prior to the conclusion of a contract.

5. In the presence of freely given, specific, informed and unequivocal consent for this by the subject of the personal data. Where processing is carried out on this basis, the data subject may withdraw it at any time by contacting us at the contact details specified in point II above. The withdrawal of consent does not affect the lawfulness of the processing carried out by SA based on the consent given before its withdrawal.

 

 

V. Objectives

 

 

Information that may contain your personal data is processed for the following purposes:

- Profile of mental skills for sports;

- Provision of administrative services;

- Obtaining data from questionnaires in order to optimize the work process;

- Fulfillment of obligations, exercise of rights, organization of activities in the field of human resources;

- Fulfillment of obligations, exercise of rights, reporting and other actions in connection with legal relations with counterparties;

- Processing requests by ZDOI;

- Recording of data collected by biofeedback software;

- Complaints, reports and other requests.

 

 

VI. Data categories

 

 

1. Human resources

For the purposes of mental training of athletes and other trainees, we process personal data.

The collected data is used only for the above-mentioned purposes and is provided to third parties only in cases where this is provided by law or contract.

In connection with the performance of employment or service legal relationships, only the personal data required by law are processed, which are stored within the terms determined by the labor and insurance legislation.

Personnel selection procedures comply with the requirements of special laws governing this activity.

2. Counterparties

In the performance of its activities and in connection with its powers, STOKODA ACADEMY processes personal data of natural persons for the performance of contracts concluded by STOKODA ACADEMY in the sense of national, European and international law.

Insofar as it is possible to collect personal data of individual natural persons in connection with the execution of these contracts, information will be processed for them in a minimum volume, so that it is sufficient for the exact performance of the obligations under the relevant contract. Access to this information is granted to third parties only when this is specified in a special law or results from an international agreement binding on STOKODA ACADEMY.

3. Personal data provided when requesting services from users

Requests for the provision of services in connection with the exercise of the powers of STOKODA ACADEMY are submitted in accordance with the terms and conditions of the current legislation.

When working with the information contained in the applications and the documents attached to them, as well as any other documents deposited in STOKODA ACADEMY, only personal data relevant to the specific case is processed. Data made known to STOKODA ACADEMY in this connection may be provided to third parties only when such transfer rests on a lawful basis.

4. Use of cookies

A "cookie" is a small amount of data that a website stores on a visitor's computer or mobile device during a visit. You can set your browser to refuse, remove or block cookies or to show you when a cookie is generated without affects the use of most of the functions.

 

 

VII. Recipients of the data

 

 

- Electronic payment systems and/or banking institutions in connection with servicing payments to customers or to counterparties;

- Service providers, persons carrying out maintenance of information systems and networks, etc.;

- Judiciary authorities may have access to personal data on the created files when acts are appealed before them;

- Municipal bodies and bodies of the Ministry of the Interior receive access to the personal data contained in the AUAN and NP, upon delivery of the AUAN and NP with their assistance in the order of ZANN (Art. 84 ZANN in relation to Art. 178 of the Civil Code);

- The International Bureau of the World Intellectual Property Organization and EUIPO.

VIII. Rights of subjects

 

 

1. Right of access and right of copy of personal data

The individual has the right to receive confirmation as to whether we are processing his personal data. If so, you can access the personal data and certain information about how it is processed.

2. Right to correct personal data

Individuals have the right to request the correction of personal data that is inaccurate or incomplete.

3. Right to deletion ("right to be forgotten")

Individuals have the right to request the deletion of personal data when they are no longer necessary for the purposes for which they were collected or otherwise processed, as well as in other cases provided for in the Regulation, for example if they wish to withdraw their consent or their data is were processed unlawfully.

It should be borne in mind that the person cannot request deletion when: the data is processed in fulfillment of a legal obligation, for the performance of a task in the public interest, in the defense of legal claims or for statistical purposes.

4. Right to restriction of processing

If the person contests the accuracy of his personal data for a period that allows us to verify this accuracy, as well as in other cases provided for in the Regulation, that person may request the restriction of the processing of his personal data.

5. Right of Portability

Where the processing takes place in an automated manner, the individual has the right to receive the personal data they have provided to us in a structured, widely used and machine-readable format, as well as the right to transfer such personal data to another personal data controller when the processing of such personal data:

- is based on consent or a contract with us and

- is done in an automated way.

When the individual has exercised his right to portability, he has the right to ask STOKODA ACADEMY to directly transfer his personal data to another administrator, where technically feasible.

6. Right to object

The person has the right, on grounds related to a specific situation, to object to the processing of personal data concerning him, when such processing is based on the legitimate interests of STOKODA ACADEMY.

7. Right of appeal to the supervisory authority

If the person considers that his personal data has not been processed lawfully, he can contact the Commission for the Protection of Personal Data at tel. 02 91 53 518, e-mail: kzld@cpdp.bg and file a complaint.

 

 

 

 

IX. Exercise of rights

 

 

If a person wishes to exercise any of his rights or has questions regarding the processing of his personal data, he may contact STOKODA ACADEMY at the contact details specified in section II of this policy. STOKODA ACADEMY examines the inquiry and within 30 days of receipt sends its response. If necessary, this period can be extended by up to two months, for which the relevant person is informed in a timely manner.

When submitting requests for the exercise of rights pursuant to Regulation (EU) 2016/679 before STOKODA ACADEMY, you will be asked to identify yourself - by providing an identity document that is returned immediately, by electronic signature or by other methods and means of identification.

If a request to exercise rights is refused, the person who submitted it will be notified of the reasons why no action has been taken on it, as well as the possibility to file a complaint with the Commission for the Protection of Personal Data and seek protection judicially.

The personal data processed in connection with the consideration of the individual requests will be used only for the purposes of exercising the specified rights.

 

 

X. Guarantees for the protection of personal data

 

 

STOKODA ACADEMY applies various measures to protect the personal data it processes. The right to handle the different categories of personal data has only persons whose official/contractual commitments require working with them, and their access is limited only to the information they need to perform the necessary actions and only for the time during which it is necessary to use it.

All electronic and paper media containing personal data are properly protected with appropriate organizational and technical measures in accordance with the requirements of Regulation (EU) 2016/679 and applicable law.

 

 

XI. Final provisions

 

 

This policy is approved by Order No. 1/05.10.2020 of the chairman of STOKODA ACADEMY, KOJABASHEV AND CO. LTD., Stoycho Kodjabashev and comes into force from the date of issuance of the same order.
